Accident with TV today

Its been one of those days!! This morning I took my family out to breakfast. When we left the restaurant we were driving down the road and in front of us was a painters truck, and on the back of his truck he had a 5 gal. bucket of paint that was tipped and leaking paint onto the road. I was trying to avoid the paint. As he got to the corner to turn the bucket fell off the truck and white paint was everywhere, I moved to the  right as far as i could to avoid the paint, i wasn't paying attention to the light which was red i guess, anyway i thought  we had the green light because the painters truck turned, i was trying to avoid the paint not watching so I turned to the right, Just as i did i heard a semi horn blow, I just happened to look in the rear view mirror on my door and noticed the semi close to me so I moved to the right as fast and far as I could, but there was construction and they had a cement block wall up so i could go over only so far. Before we knew what happened the semi hit us in the front left side on the car in my door and left front fender. When we finally came to a stop we were trapped in the car between the front wheel of the semi and the block wall. If i hadn't seen the semi in my mirror he would have hit us in the rear end and I hate to think of what would have happened then. Luckily we were OK, just shaken up. My little girls were in the back and this is something you hope they never have to see. The highway patrol was there in a matter of minutes along with the fire dept. They had to finally pull the front of the semi away from us, because we were hooked on his front wheel. The car is drivable so we pulled up a ways to the side of the road to do the paper work. The driver of the semi was OK. The guy driving the painters truck never stopped. I called my insurance and I have an appointment tomorrow at Fishers Auto Body for pics and an estimite. I also got a ticket for failure to stop at the light. I think I will go to court and fight the ticket, because of the circumstances.   :sombraro:  :%

Wow!!! Sorry to hear about that :( . I'm glad that everyone was OK :) .

How scary!  I was pretty shaken when a deer hit my car and dented in my front fender.  Can't imagine being caught in between a semi and a cement wall!   :yikes:   I'm glad that you and your family did not get injured and are well.

Having noticed you bobbing and weaving to avoid the spilling paint, he probably thought you were driving erratically and when the accident happened he probably figured you were drunk or something!  Unbeknownst to him, he caused the accident.

By chance did the police observe the paint everywhere to corroborate your story, and/or were pictures taken to show it?  Did the semi driver also mention the paint truck?  That will help your ticket fighting case, as well as if you were the cause of the accident from recklessness (failure to stop) or if it was the result of extreme evasive measures of a road hazard (I'm not official -- I just sound like it!)

I am glad that you and your family are OK.  The TV can be fixed so all is well. :)

Wow...looking at a semi coming at ya certainly must get the adrenaline going!  Whew....sure glad to hear no one was hurt!  Good luck with the ticket.  :>

The Semi driver also noticed the painters truck and the spilled paint. The police took alot of pics of the road with the paint mess and our vehicles. I think i can win my case. Also there were road workers who saw everything. The only bad part was that nobody got the license plate number af the painters truck. It makes me mad he didn't even stop......That for all the concern everyone!!!......Ed C.

P.S. I talked to my insurance today and they told me as long as the damage to the  semi isn't over $1000.00 dollars our insurance rates shouldn't go up. I've been with State Farm for 26 years and this is my first ever claim. The damage to the semi should be around 6-7 hundred dollars.

The guy in the painter's truck upon arriving at the job site, "WHERE IS THAT FIVE GALLONS OF PAINT"!!? :confused:

Fisher Auto Body called me today and told me the repairs would be around $3300.00 dollars. They'll have to keep my TV for a week and a half, so I'll have to get a rental. This sucks!!!!

I doubt that the paint truck driver knew that he was leaking paint/lost the paint.  He may not have even know that you were in an accident, since you were behind him, I am assuming you were not close to the paint truck because of the leaking paint.  :)
